NY trout violations: check the water, reach, season & gear before the ticket
“The trout limit is five” is one of the easiest ways to misunderstand New York fishing law. A special reach may allow three trout, one trout, zero harvest, artificial lures only — or no fishing at all.

A trout citation does not have one universal dollar amount
New York separates the offense itself from statutory civil liability. The actual result depends on the violation charged, number of fish involved, prior history, settlement and court process.
General violation
Up to $250Unless the offense is made a misdemeanor or another specific penalty applies, the general violation provision authorizes:
- up to $250 fine,
- up to 15 days imprisonment,
- or both.
Separate civil liability
This is the general civil-penalty schedule unless another penalty is specifically provided.
It should not be described as an automatic roadside-ticket total.
License consequences

Why “3 illegal trout = a $500 ticket” is too simplistic
Most ordinary Fish & Wildlife Law violations that are not made misdemeanors fall under the general violation provision.
ECL §71-0919 says a violator is also liable to the applicable civil-penalty schedule, including §71-0925 when it controls.
Repeat violations, failure to appear and other circumstances can create separate license consequences.
What conduct can turn into a trout regulation violation?
Too many trout
Five may become three, one or zero on a special reach.
Too many large trout
Many five-fish waters allow only two over 12 inches; SE/WQ allows only one.
Targeting trout when closed
Catch-and-release does not automatically make a closed season legal.
Worms in artificial-only season
Standard winter inland-stream trout season is artificial lures only.
Keeping a snagged trout
Foul-hooked trout must be released without unnecessary injury.
Fishing past a boundary
Bridge, dam and road boundaries can change the rule on the same stream.
Livewell on catch-and-release water
Catch-and-release fish may not be placed in a bucket, tub, livewell, stringer or other holding device.

Beaver Kill — Horton
From Iron Bridge at Horton downstream to the first Route 17 overpass, angling is prohibited July 1 through August 31.
Purpose stated by DEC: protection of thermally stressed trout.

On Caledonia State Fish Hatchery property as posted, angling is prohibited from 3:30 PM to 8:00 AM.

What “artificial lures only” means for winter trout fishing
Typical artificial-lure examples
- man-made flies,
- spinners,
- spoons,
- plugs,
- jigs,
- other artificial imitations of natural bait.
DEC’s definition can include some natural construction material such as deer hair or feathers.
Do not use these where artificial-only applies
- worms,
- live/dead fish,
- fish eggs,
- insects,
- corn or vegetable matter,
- meat or liver,
- bread, cheese or candy,
- putty/dough-like scented baits.
Three lines are allowed statewide — until a special rule reduces them
Set lines left unattended are prohibited.
Legal-size does not save a foul-hooked trout
Foul-hooked trout and lake trout must be released without unnecessary injury.
Snagging, lifting and similar methods are not legal ordinary angling.
Use or possession of gaffs/gaff hooks while freshwater fishing is prohibited except specified ice-fishing or bowfishing situations.
Aquatic insects and trout eggs have their own statewide restrictions

Aquatic insects — including insects that live in water during any stage of their life — may not be taken from waters inhabited by trout or from the banks of those waters.

Your cooler in the car can change how many trout you may legally keep
Fish in a vehicle used to access the water count toward the number and sizes of fish in possession.
Count existing possessed fish before putting another trout in the creel.
You may continue fishing during an open season, but each additional fish of that species must be immediately released.
Keep brook trout and lake trout identifiable and measurable
Legally harvested fish may be gilled or gutted while on the water.
Do not cut, fillet, skin or otherwise alter the fish so species or total length cannot be easily determined.
Same identification/measurement protection applies.
Transportation has a separate possession rule
New York’s general transportation rule limits transportation of non-salable fish caught in New York to no more than two days’ legal take, unless a DEC Regional Office permit is obtained or the fish are frozen, processed and packaged for storage under the regulation.
Recreationally caught trout generally are not a fish-market product
New York classifies fish with a minimum length or closed season as non-salable under the general freshwater rules. Trout from a properly licensed fishing preserve or private hatchery can qualify for specified exceptions when properly tagged or documented.
Most trout anglers age 16+ need the New York freshwater fishing license
From date of purchase or renewal.
Most anglers age 16 or older need a license when fishing for freshwater fish unless an official exemption applies.

Refusing to exhibit a license is specifically addressed in the penalty statute
ECL §11-0705 requires a holder to exhibit the license on lawful demand to specified officers and to qualifying owners, lessees or persons controlling the land or water.

Repeat violation
ECL §11-0719 allows DEC to revoke licenses and deny the fishing privilege for up to five years when a person has the qualifying current and prior Fish & Wildlife Law conviction or acknowledged civil settlement within the preceding five years.
Failure to appear
If the court reports a failure to appear within three months of the return or subsequent adjourned date, DEC may suspend hunting/fishing/trapping licenses pending appearance.
The statute provides for advance notice before that suspension takes effect.
A wildlife-license suspension may not stop at a state line
New York’s enforcement law recognizes the Interstate Wildlife Violator Compact. A qualifying suspension or revocation imposed by another participating state can form the basis for corresponding New York privilege action for the same privilege and period.
Five practical things to do
Keep the encounter calm and straightforward.
Show the acceptable proof requested.
Number, species, sizes and location matter.
Note the law/regulation and alleged conduct.
Failure to appear can lead to a separate license-suspension problem.
Run this before every New York trout trip
- Check license expiration. Annual New York freshwater licenses run 365 days from purchase/renewal.
- Carry proof. Do not assume the officer can simply look you up.
- Search the exact water in HuntFishNY Tackle Box.
- Match the exact reach. Bridge, dam, road and tributary boundaries matter.
- Check today’s date. Open harvest, catch-and-release or fully closed?
- Know the category. Wild/Stocked, SE/WQ, Wild-Premier or Catch & Release.
- Count larger trout separately. Many limits contain a “longer than 12 inches” sublimit.
- Check bait and gear. Artificial-only seasons prohibit natural bait.
- Count fish already in the vehicle. They can count toward possession at the water.
- Immediately release C&R fish. No livewell, stringer, bucket or delayed release.
- Release foul-hooked trout.
- Keep brook/lake trout identifiable.

What is the fine for an illegal trout in New York?
There is no single automatic trout-ticket amount. Unless an offense is made a misdemeanor or another specific penalty applies, ECL §71-0923 provides for a violation punishable by up to $250, up to 15 days imprisonment, or both. ECL §§71-0919 and 71-0925 separately provide for applicable civil liability, generally $200 plus $100 for each fish involved unless another penalty controls.
Is the New York trout limit five fish everywhere?
No. Standard Wild/Stocked inland streams use five trout with only two longer than 12 inches during April 1–October 15. Stocked-Extended and Wild Quality reaches use three with no more than one longer than 12 inches. Wild-Premier reaches use one trout. Catch & Release reaches allow zero harvest.
Can I keep trout from a New York stream in winter?
On standard inland trout streams, October 16 through March 31 is catch-and-release only and artificial lures only. No trout may be harvested during that winter stream period. Special regulations can differ.
Can I use worms for trout in January in New York?
Not on a standard inland trout stream during the October 16–March 31 catch-and-release period because artificial lures only are allowed. Always check the exact water and reach.
Can I catch and release trout during any closed season?
No. New York’s general rule prohibits fishing for a species, including catch-and-release fishing, during a closed season unless another regulation expressly provides an open catch-and-release season.
Is any Beaver Kill trout water closed in August?
Yes. On the Beaver Kill from Iron Bridge at Horton downstream to the first Route 17 overpass, angling is prohibited from July 1 through August 31 to protect thermally stressed trout.
What changes on the Salmon River on August 15?
On the Salmon River downstream of the Route 52 Bridge in Altmar, August 15 begins the seasonal period with special night-fishing, hook, weight and rig requirements that continue through April 14.
Can I put a catch-and-release trout in a livewell before releasing it?
No. New York’s catch-and-release rules say fish may not be placed in a bucket, tub, livewell, stringer or another holding device. Measuring, weighing and photographing are allowed only when the fish is not kept out of the water for an extended time or handled harmfully.
Do trout already in my car count toward my New York possession limit?
Yes. DEC states that fish in a vehicle used to access the water count toward the number and sizes of fish in possession.
Can I keep fishing after I already have my trout limit?
During an open season, New York allows a person to continue fishing for a species while already possessing the daily limit, provided every additional fish of that species is immediately returned to the water.
Can I keep a foul-hooked trout in New York?
No. Foul-hooked trout and lake trout must be released without unnecessary injury.
How many fishing lines can I use for trout in New York?
The statewide angling rule generally permits no more than three lines. Each line may contain no more than five lures or baits and no more than 15 hook points. Special waters can impose tighter limits.
Do I need to carry proof of my New York fishing license?
Yes when a license is required. ECL §11-0705 requires the holder to have the license or other acceptable proof on their person while exercising the privilege and to exhibit it on lawful demand.
What happens if I refuse to show my New York fishing license?
ECL §71-0923 specifically treats refusal to exhibit a license on demand under the general violation provision, which authorizes up to a $250 fine, up to 15 days imprisonment, or both.
Can a trout violation cause my New York fishing license to be revoked?
It can in qualifying repeat cases. ECL §11-0719 allows DEC to revoke licenses and deny fishing privileges for up to five years when the statutory repeat-violation conditions apply.
Can missing court for a fishing ticket suspend my license?
Yes in qualifying circumstances. If a court reports failure to appear within three months of the appearance-ticket return date or later adjourned date, ECL §11-0719 allows DEC to suspend fishing privileges pending appearance, subject to the statutory notice process.
Are trout regulations waived on New York Free Fishing Days?
No. Only the freshwater fishing-license requirement is waived. All seasons, size limits, daily limits, gear restrictions, catch-and-release requirements and special-water rules remain in force.
How do I report suspected illegal trout fishing in New York?
Call the NYSDEC Report All Poachers and Polluters hotline at 1-844-DEC-ECOS (1-844-332-3267). DEC advises witnesses to keep their distance and not confront suspected violators.
A New York trout rule is really six rules combined
Before fishing, match: exact water + exact reach + species + date + possession limit + legal bait/gear.
Then check whether fish already in your vehicle, a special catch-and-release rule, Great Lakes regulation, time-of-day restriction or license-proof requirement changes the answer.
